1.1. Philipp Scholz & Ronny Glotzbach GbR Psychofit Psychologische Beratung, Fritz-Haber-Str. 5, 67454 Haßloch (hereinafter Psychofit)
1.2. The person who uses psychological counseling services from Psychofit and has given their consent to this counseling agreement by actively agreeing at the time of purchase. The specific person is identified by the data on the invoice associated with the purchase (hereinafter Client).
The Client receives psychological counseling from a bachelor-level psychologist. Each session lasts 50 minutes and takes place as individual counseling. A change of counselor during the course of treatment is possible upon consultation.
Please note that there is no entitlement to full or partial coverage of counseling costs by statutory health insurance or any other cost bearer. Coverage by private health insurance is subject to individual case review at most and cannot be guaranteed.
Psychofit charges fees of 25€ (first session) and 49€ per subsequent counseling session for a session duration of 50 minutes. For students (with a valid student ID), the price is 25€ per counseling session. (exempt from VAT pursuant to §19 UStg).
If an appointment is cancelled less than 2 business days (1 day equals 24 hours, business days are Monday to Friday) before the scheduled appointment, a cancellation fee of 100% of the agreed fee applies. If the Client arrives more than 15 minutes late to a session, the cancellation fee (100%) will also be charged. The cancellation fee does not apply if the non-attendance was beyond the Client's control and the Client can provide appropriate proof (e.g. by presenting a medical certificate following short-notice illness). This proof must be submitted by the Client within 48 hours of the missed appointment to kontakt@psychofit.de. It is at Psychofit's discretion to accept or reject the proof. The Client undertakes to attend appointments in a quiet, undisturbed location and to be reachable during booked appointments at the phone number provided during registration. This allows the appointment to take place by phone as an alternative if technical issues arise. If the Client is not reachable by phone and the session cannot take place due to technical issues, the cancellation fee applies. The cancellation fee also applies if the Client is at a location where the session cannot take place due to noise or safety concerns (e.g. public transport, café, driving).
To facilitate the processing of transactions, the Client agrees to pay the costs for all booked paid counseling sessions in advance at each booking. If Psychofit offers time-limited promotional deals, these may lead to corresponding cost reductions. Invoicing is done electronically and only as needed.
In cases where counselors are subject to professional confidentiality, the Client hereby grants revocable consent for the assigned counselor to share all treatment data required for billing of counseling services provided (name, date of birth, address, health insurance if necessary, findings, treatment history, etc.), including “personal data,” with Psychofit for the purposes of billing and treatment coordination. To this extent, the Client expressly releases their counselor from professional confidentiality.
This also covers the case of a counselor change (e.g. due to unavailability or departure of the previous counselor): in this case, Psychofit is entitled to share the information required for continuing the counseling with a newly assigned counselor, or to allow the previous counselor to provide a case summary limited to the necessary extent for preparation and continuity of counseling to Psychofit and/or the newly assigned counselor.
The Client is informed that the content of counseling sessions may be discussed in anonymized form as part of the supervision of counselors. The supervisor and all participating counselors are in turn subject to confidentiality regarding the subject of supervision. The goal of supervision is to improve counseling quality.
Psychofit offers the optional “Session Notes” feature in the client portal. This feature allows counselors to create notes on counseling sessions and the Client can add their own reflections.
The creation of client-visible notes and client reflections requires the Client’s explicit consent (Art. 9(2)(a) GDPR). Private counselor notes that are visible only to the respective counselor may also be created without separate consent (Art. 6(1)(f) GDPR – legitimate interest in counseling documentation for quality assurance).
All session notes are stored encrypted on the server side using AES-256-GCM. Consent can be revoked at any time in the client portal. Upon revocation, all notes visible to the Client as well as their own reflections are irrevocably deleted. Private counselor notes remain with the counselor as they constitute their work documentation and are subject to counselor confidentiality.
The Client has been informed that this counseling does not replace a medical examination and that they are encouraged to independently consult a physician if symptoms of clinical significance arise. The Client acknowledges that intensive engagement with one’s own problems may initially lead to an increase in symptoms.
The Client confirms their awareness that Psychofit’s office hours are intended exclusively for scheduling and organizational matters and that psychological support outside of sessions cannot be guaranteed. This also applies in the event of a crisis.
The Client undertakes to contact their general practitioner, the telephone counseling service (Telefonseelsorge) or the local social psychiatric service in the event of a crisis. In case of acute risk of self-harm or harm to others, the Client undertakes to immediately contact emergency services (Tel: 112) or go to the emergency department of the nearest psychiatric hospital.

For the first paid counseling session, Psychofit grants a satisfaction guarantee. If the Client is not satisfied with the first session, they may request a full refund of the session price within 24 hours after the end of the session. Further details are governed by the Terms & Conditions under § 7a. The Client’s statutory rights remain unaffected.
